PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.

I agree that I am over the age of 18 and that the recipient of these goods is also over the age of 18. I agree that any products purchased from Nang Delivery Sydney Pty Ltd will be used only in accordance with the manufacturer’s recommendations. I agree that I will not inhale this product nor will I distribute this product to anyone in circumstances where I am aware that they intend to inhale it. I agree I will not distribute this product to any person(s) under that age of 18. I acknowledge that to the extent permitted by law Nang Delivery Sydney Pty Ltd is not liable for any damages whatsoever arising from or in any way connected to the misuse of these goods and that any evidence of intended misuse coming to our attention before delivery will result in Nang Delivery Sydney Pty Ltd rescinding the sale agreement and restricting future sales to me. I agree that Nang Delivery Sydney Pty Ltd will ask to see proof of age before delivering the goods and my refusal to display a valid photo identification at the point of delivery will result in the contract being rescinded and you will be charged a $50.00 drive out fee. Property and risk in the goods passes upon delivery to the client. Ownership of the goods shall not pass to you until the Supplier has received in full (in cash or cleared funds) all sums due to it in respect of:
– the goods, and
– all other sums which are or which become due to the Supplier from you on any account.
The Supplier shall be entitled to recover payment for the goods even though ownership of any of the goods has not passed from the Supplier.

By accessing, visiting, browsing, using or attempting to interact with any part of this website, or other Nang Delivery Sydney Pty Ltd services, websites or any of Nang Delivery Sydney’s Pty Ltd licensees services or software (collectively “services”), you agree that you have read, understand and agree to be bound by this agreement. If you do not agree to be bound by this agreement, please do not access or use any part of this website.

Nang Delivery Sydney Pty Ltd reserves the right, from time to time, with or without notice to you, to make changes to this agreement in Nang Delivery Sydney’s sole discretion. Continued use of any part of this website constitutes your acceptance of such changes. The most current version of this agreement, which supersedes all previous versions, can be reviewed by clicking on the “terms of use” hyperlink located at the bottom of each page on the Nang Delivery Sydney website.

*Safety & Misuse*

Whipped Cream Chargers supplied from this website must only be used for the preparation of food. The cream chargers contain a gas called Nitrous Oxide that can be abused in the same way that glue or solvents are. In order to combat this, we require that any customer purchasing our products confirm they are aware of the issues and will make every effort to prevent our products from being misused. Also we issue this warning if we suspect that you intend to misuse our products, we will refuse to sell any equipment to you. We will also refuse to do business with you in the future and your account (name, addresses etc.) will be barred.

It is an Offence to sell cream whipping chargers for the purpose of inhalation.

The risks of such misuse include narcosis, asphyxiation and potentially, death. Keep out of reach of children.

We will not sell to anyone under the age of 18. We require confirmation of your age when you create an account with us and on arrival of goods.

*Product Safety*

Before using our whipped cream making equipment you must first read the manufacturers instructions. This will show you how to safely charge your cream using the cream whipping chargers.

No more than 1 charger should be released in a 1/4L or 1/2 Litre Whipper and no more than 2 chargers for a 1 Litre Whipper. An explosion could occur from excessive pressure if you use more than stated.

– These chargers contain liquid Nitrous Oxide under great pressure. Any attempt to pierce the sealing cap of these chargers without the correct equipment could result in EXPLOSION INJURY & SERIOUS FREEZE BURNS.

– EXPLOSION DANGER – do not incinerate or expose chargers to the sun or heat. Temperature not to exceed 50C.

– Do not dispose of full chargers. They may cause someone else an injury!

– Keep out of reach of children.

– NOT TO BE FLOWN! Pressurised gas cartridges must not go on a plane at all. No excuses, you may be prosecuted.

CONSUMER TERMS OF SALE

  1. Format of the Contract

1.1 These terms of sale apply to all goods supplied by Commerce Enterprises Pty. Ltd (trading as Nang Delivery Sydney)

1.2 Any order placed by you for goods advertised on our website is an offer by you to purchase the goods selected in your order. No contract exists between you and us for the sale of any goods until we have received your order and accepted it (which we may do at our discretion).

1.3 We will send you an order acknowledgement shortly after you place your order, notifying you that we have received your order. This acknowledgement is not notification that we have accepted your order.

1.4 If we accept your order, we will notify you by email that we have accepted it prior to dispatch of the goods. If we cannot accept your order (for example (but without limitation) because the goods are found to be unavailable) we will notify you by telephone or email.

1.5 In the event that, after we accept your order, we discover that the goods ordered are unavailable or that there was a pricing error on our website in respect of the goods ordered, we reserve the right not to supply the goods ordered and to offer you a refund or alternative goods in accordance with conditions 2.2 to 2.4 below. Note: If an item is out of stock, we reserve the right to automatically give you a free upgrade to a premium brand, such as Bestwhip or ISI.

1.6 The contract is subject to your right of cancellation (see condition 7 below).

1.7 We have the right to terminate the contract if the price of the goods is not received from you in cleared funds (in accordance with condition 3.1).

1.8 The Supplier may change these terms of sale without notice to you in relation to future sales.

  1. Description and price of the goods

2.1 The description and price of the goods you order will be as shown on the Supplier´s website at the time you place your order.

2.2 If after acceptance of your order we discover within 14 days of such acceptance that all of the goods are unavailable, we may terminate the contract and refund or re-credit you within 7 working days for any sum that has been paid by you or debited from your credit card for those goods. In these circumstances, we will inform you as soon as possible.

2.3 If within 14 days of our acceptance of your order we discover that some but not all of the goods are unavailable, we will no longer supply those unavailable goods. In these circumstances we will contact you detailing the goods that are unavailable and offer you the option of cancelling the whole order or amending your order to substitute the unavailable items with alternative goods. If you have not cancelled the order within 14 days of receipt of such notice, we will deliver the available goods in accordance with condition 4 below. We will refund or re-credit you for any sum that has been paid by you or debited from your credit card in respect of the unavailable goods or cancelled order (if you have cancelled it).

2.4 Every effort is made to ensure that prices shown on the Supplier´s website are accurate at the time you place your order. If within 14 days of accepting your order a pricing error is found in respect of any or all of the goods you have ordered, we will notify you as soon as possible detailing the miss-priced goods and offering you the option of:

2.4.1 placing a new order at the correct price for those goods;

2.4.2 cancelling the whole of your order; or

2.4.3 cancelling your order for the mis-priced goods and reconfirming your order for the correctly priced goods.

If, within 14 days of receipt of our notice to you, you have not responded by selecting one of the available options at conditions 2.4.1 to 2.4.3 above then:

(a) if all of the goods you have ordered are found to be mis-priced, the entire order will be cancelled automatically and the Supplier will refund or re-credit you for any sum you have paid for those goods; or

(b) if only some of the goods you have ordered are found to be mis-priced, our contract with you continues and we will deliver the correctly priced goods but we will not be obliged to supply you with the mis-priced goods. In these circumstances we will refund or re-credit you for any sum you have paid for the mis-priced goods.

2.5 To avoid any doubt, where goods are unavailable and you order alternative goods from us, or where goods have been mis-priced and you subsequently order such goods at the correct price, these terms of sale shall apply to the order and the supply of the relevant goods, whether the order is placed through our website or otherwise.

2.6 In addition to the price, you may be required to pay a delivery charge for the goods, details of which are clearly displayed on our website at the point that you place your order.

2.7 Any free items are subject to availability, including the branding of any such items.

“Nangs” is a slang term in Australia for nitrous oxide whipped cream chargers. Specifically, nangs usually refer to whipped cream bulbs. They can also be referred to as another slang term “whippits”. There is a brand named  “Whip-it”. Nangs (whipped cream chargers) are 8 gram, small stainless steel bulbs that are filled with food-grade nitrous. Each 8-gram nang weighs approximately 25 grams and is 0.43cm x 6.35cm. Nangs should not be confused with CO2 soda bulbs, which are commonly used for making soda water as well as for airguns. Nangs like other things, pose the potential for abuse by humans. While the dependencies from nitrous oxide are not severe, chronic abusers of nangs can maintain emotional dependencies and brain damage, which can have the potential to be highly destructive to the abuser and those around him. The inhalation of nitrous oxide is also known to produce harmful side effects in humans. Nangs are known to suppress the body’s ability to absorb vitamin B12. More common is the release of the freezing gas directly into the body from the whipped cream charger. The nitrous in the nang is very cold and is capable of burning the user’s face, lips, throat or tongue. Death from nitrous is rare but can happen if a person attempts to inhale it and can asphyxiate themselves. The possession of nangs, or otherwise nitrous oxide found in nangs, is legal in Australia, USA, Europe, UK, and many countries – however with the intent to abuse or inhale is not. Like all food products related to food, nitrous oxide is regulated. The possession of crackers or other devices that serve no purpose but to open a whipped cream charger is outlawed in some areas. Nang Delivery Sydney will not knowingly sell to anyone who uses our products for these purposes.
